The case against double jeopardy in tvN’s Confession

This is definitely one of the shows I’m most looking forward to this year. Confession is busy preparing for its upcoming premiere next month, and tvN has recently released a teaser clip to make sure we get properly excited for the show. Not that I need anything more to get excited about given Junho (Greasy Melo) and Yoo Jae-myung (Hundred Million Stars From the Sky) are starring, and the director of Mother is at the helm.

The teaser itself is quite brief, and really just gives us a snapshot of what the show will be about. The first shot is that of an eagle view of an alley crowded with police cars, with the captions reading, “The principle against double jeopardy. Republic of Korea’s Criminal Code Article 13 clause 1.” The teaser goes on to explain the principle, saying that a case that has been decided may not be tried again.

But the real meat of the show (and the principle) is that a defendant who is found innocent, will remain forever innocent. Flashes of a police dog, a hand throwing a piece of paper into a fire, and police taking pictures at a crime scene appear. The clip ends with shots of Junho, who will play a defense lawyer, and Yoo Jae-myung, a former detective who looks rather menacing. I’m not sure the two will be strictly playing on the same side, at least at the beginning, but I look forward to their interactions, whether as friend or foe.

Confession is slated to premiere next month on tvN.

At his fan sign, Junho said the teaser is only a small glimpse of what they have already filmed so far. I'm excited. It's been a while that I don't wait to marathon later and will follow a drama live, but I may break it here.

I was interested to see how Junho would be styled here and so far it's a fresh and clean-cut look, the hair thankfully setting it apart and not too reminiscent of his character in Memory.

So basically SK adapted the same principle you have in US law? You cannot put someone on trial again if he/she was found innocent the first time around? I think in the US the only way to get a new trial for the same offence is if new evidence has been found which in most cases never happens.

Nope, even if a killer confessed to the murder, they found video of it and there was conclusive DNA evidence, as long as he or she had already been tried on the same set of facts and found not guilty s/he couldn't be tried for the crime again. No possibility of serving jail time. However, he or she could be sued under civil law, as OJ Simpson was for the wrongful deaths of Nicole Brown Simpson and Ron Goldman following his not guilty verdict in criminal law. There is no double jeopardy, in that case, because the penalty is not imprisonment or corporal punishment, it's an award for damages (money). Despite OJ Simpson's not guilty verdict, a civil court jury found him liable for the deaths and awarded $33.5 million in damages to the victims’ families. It is largely uncollected, but if he makes a book deal or signs autographs at an event, the money can be collected

15 seconds and barely any shots of the actors safe for that 3 seconds shot of Junho. But I'm sufficiently intrigued. I reaalllly hope this drama will turn out well, and considering it has about 2 months worth of pre-production we might get a satisfying drama.

Thanks for your update on CONFESSION, @tipsymocha! I'm looking forward to it, too. It will be interesting to see how double jeopardy will be dealt with in order for justice to be done. I'm guessing that the guilty party who got off scot-free will have to be successfully convicted of another equally-heinous crime.

CONFESSION ought to tide me over until Junho's sageuk film GIBANG BACHELOR premieres later this year. ;-)

I had similar thoughts, but Junho is a defense attorney. So I wonder how they are going to position his character in relation to morality and justice.

Thanks for pointing that out. Hmmm. Maybe the best defense is offense?

I'm under the impression that the lawyer's father had been framed. (Is he even still alive, or has he already been executed?) It could be a matter of clearing dad's name after turning up new evidence that proves a different perpetrator, or at the very least raises reasonable doubt as to the validity of the original conviction. (Depending on how long ago it happened, DNA evidence of an unindicted party might exist which had not been viable until technology advanced sufficiently.) Lodging an appeal to exonerate a falsely-convicted defendant does not constitute double jeopardy. But I could imagine a twist in which the original defendant got off the hook by framing someone else (lawyer's dad) -- and literally got away with murder.

Re: the protagonist in relation to morality and justice, I'm wondering if we might get a variation on LOOKOUT's Prosecutor Jang Do-han, whose quest for justice for his father took him over the moral brink. Will he consort with the Truck Of Doom to wreak vengeance on a perpetrator who has subverted the long arm of the law???

The title of the show is CONFESSION, which makes me wonder how it was obtained. I can see it all now: the baddie was released on a technicality, while Dad was brutalized, or threatened with harm to his family, into copping to a crime he did not commit. I have a feeling that my blood will be boiling over Pops getting railroaded by the usual cabal of corrupt prosecutors and their highly-placed masters.

Will this be a weekend or weekly drama? For some reason, the days of the week in which a drama air make all the difference to me. Like monday-tuesday I like romances. wed-thursday I like gritty. Friday I need the best dramas to be on that time slot. Saturday sunday -- either something REALLLY good... or something meh but just enough to keep me alive. (Am i the only one?)

It's odd you feel this way since Junho's been consistently good in all his roles, but I guess sometimes some actors can just rub people the wrong way.

Definitely interested in watching Junho in this role. He has that special something that he brings to his characters. He's always made quite the impression.
